terms of service & copyright complaints policy

these terms of service ("terms") govern access to and use of spillit.online and its associated features, services and functionalities (collectively, the "platform"), operated by spillit anonymous campus network ("spillit", "we", "us" or "our").

by accessing, registering for or using the platform, you agree to comply with these terms and the policies incorporated into them, including the [ privacy policy ] and [ community guidelines ]. if you do not agree to these terms, you must discontinue use of the platform immediately.

statutory intermediary status: spillit, its individual owner(s), developers, operators, and host entities operate strictly as an intermediary as defined under section 2(1)(w) of the information technology act, 2000, and claim all safe harbour protections under section 79 of the it act and the information technology (intermediary guidelines and digital media ethics code) rules, 2021. spillit is a passive digital venue; the website owner does not initiate transmissions, select recipients, or modify third-party user content.

immediate effectiveness & 7-day cure window: all terms, rules, and platform policies are effective immediately upon publication and whenever updated. in the event that an update introduces new restrictions affecting existing content or previous minor violations, users are granted a period of 7 days from the update date to edit, rectify, or remove non-compliant content before formal moderation penalties or account restrictions are applied. severe safety emergencies (such as child exploitation, non-consensual intimate imagery, doxxing, or imminent threats of physical harm) are exempt from any grace period and are acted upon immediately.

you may use spillit only if you satisfy the eligibility requirements applicable to the platform and are legally capable of entering into the relevant agreement.

the minimum age for registration shall be 16 years of age (or the minimum legal age for digital service consent in your jurisdiction), subject to applicable law. spillit may restrict access to particular features where required by law or where necessary to protect users.

users must provide accurate information when information is required for registration, verification, account recovery or compliance purposes. users must not impersonate another individual or misrepresent their identity in a manner prohibited by these terms or applicable law.

spillit provides an online community through which users may publish posts, comments and replies, participate in discussions, and interact with other users. the platform may include college-specific forums, global discussions, voting features, reporting tools and other community functionalities.

unless expressly stated otherwise, content published by users represents the views of the individuals who submitted it and does not necessarily represent the views of spillit. spillit does not warrant that user-generated content is accurate, complete, reliable or appropriate for every reader. users should exercise their own judgment when interpreting information or interacting with other members.

spillit is designed to permit participation through usernames without requiring users to publicly display their real-world identities. however, pseudonymous participation does not constitute a guarantee of complete or absolute anonymity.

users must not assume that information included in their posts cannot identify them or that technical information is never processed. spillit's collection, use, disclosure, retention and protection of personal data are described in its [ privacy policy ].

users must not attempt to discover, expose or distribute another person's private identity or personal information through unauthorised means.

to operate the platform, spillit requires permission to store, reproduce, display and distribute user-submitted content through its services. by submitting content, you grant spillit a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, display and distribute that content solely as reasonably necessary to operate, maintain, secure and provide the platform and its features.

this licence includes technical processing, formatting for different devices, displaying content to other users and retaining copies in backups in accordance with the privacy policy and applicable law. the licence does not transfer ownership of your content to spillit.

where content is removed by moderation or your account is terminated, the licence shall cease to the extent the relevant content is no longer required for the purposes described above, subject to applicable legal obligations, legitimate security needs and necessary backup-retention processes. upon account deletion, user credentials are removed while user-submitted spills and replies remain on the platform with the author display anonymized to 'deleted user'. this clause does not authorise spillit to sell a user's original posts as independent commercial content or use personal disclosures for unrelated purposes without an appropriate legal basis.

users may report content or accounts through the reporting features provided on the platform or through support@xenodochy.com. reports should identify the relevant content and describe the concern sufficiently for spillit to assess it.

spillit shall review complaints in accordance with its applicable procedures and legal obligations. where a complaint concerns an imminent threat, exposure of private information, non-consensual intimate material or another serious safety issue, spillit may prioritise its review as appropriate. users must not knowingly submit fraudulent or malicious reports to harass other members.

the submission of a report does not guarantee removal of the reported content. decisions shall depend on the circumstances, applicable policies and legal requirements.

users must not submit content that infringes another person's intellectual property rights. a person who believes that content on spillit infringes their copyright may submit a complaint using the procedure described in document 2 below (copyright complaints policy).

spillit may remove, restrict or disable access to content where appropriate and may take action against repeat infringement in accordance with applicable law and platform policies. submitting a copyright complaint does not automatically establish infringement; complaints shall be assessed on available information and the applicable legal framework.

spillit may modify, suspend or discontinue particular features for maintenance, security, operational, legal or other legitimate reasons. we will take reasonable steps to minimise unnecessary disruption where practicable.

spillit does not guarantee uninterrupted availability or that every feature will remain available indefinitely. where a material change affects users' rights or the handling of personal data, appropriate notice shall be provided where required by law.

the platform may contain links to third-party websites or services. spillit does not control independent third-party services and is not responsible for their content or privacy practices merely because a link is provided. users should review applicable terms and privacy policies before using those services.

pursuant to section 79 of the information technology act, 2000, and all applicable intermediary liability shields, the website owner, operator, founders, administrators, and hosting providers shall have zero personal, direct, indirect, vicarious, or consequential liability for any third-party content, communication link, text, image, statement, allegation, or data published or distributed by users through the platform.

to the maximum extent permitted by applicable law, in no event shall the platform owner, operator, or affiliates be liable for any direct, indirect, punitive, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, reputation, emotional distress, bodily injury, personal safety concerns, data breaches beyond reasonable technical controls, or academic/campus disciplinary outcomes arising out of: (a) user-generated posts, comments, or allegations; (b) unauthorized third-party hacking or technical data access; (c) defamatory, offensive, or illegal conduct of any user; or (d) technical outages or termination of services.

your sole and exclusive remedy for any dispute with the platform or dissatisfaction with any content is to immediately stop using spillit and request content deletion through published channels.

you agree to fully defend, indemnify, and hold harmless the website owner, operator, founders, developers, administrators, and agents from and against any and all claims, demands, damages, liabilities, losses, judgments, settlements, fines, penalties, costs, and expenses (including reasonable advocate and legal defense fees) directly or indirectly arising out of: (a) any post, comment, confession, or material you submit or transmit; (b) your violation of these terms, the community guidelines, or third-party rights; (c) your violation of any applicable law, rule, or regulation; or (d) any fraud, misrepresentation, or unlawful conduct committed by you on or through the platform.

spillit's processing of personal data is governed by its [ privacy policy ] and applicable data protection laws. users should review the privacy policy to understand what information may be collected, how it is used, how long it may be retained and what rights or controls are available. where consent is required for a particular form of processing, spillit shall obtain it in accordance with applicable law.

spillit reserves the right to modify or update these terms at any time. all updated terms, rules, and provisions are effective immediately upon publication on this page with the latest update date.

where an update introduces new restrictions affecting existing content or previous minor violations, users are granted a cure period of 7 days from the timestamp of the update to edit, rectify, or delete their non-compliant material before administrative sanctions or account strikes are applied. severe safety violations (including child sexual abuse material, non-consensual sexual content, doxxing, or credible threats of violence) are exempt from any cure period and will be removed immediately upon detection or report.

these terms shall be governed by and construed in accordance with the laws of india, to the extent applicable. disputes shall be addressed through the remedies and procedures available under applicable law.

nothing in this section prevents a user from exercising a statutory right or approaching a competent authority where legally entitled to do so. any jurisdiction or dispute-resolution provision shall be subject to applicable law and the jurisdiction of competent courts in india.
